BUYER
The name/company, address, phone number and email entered at checkout are shown to the BUYER in the order confirmation generated by the system and sent by email, and form an integral part of this Agreement.
Subject of the Agreement
The subject of this Agreement is to determine the rights and obligations of the parties, in accordance with Turkish Law No. 6502 on the Protection of Consumers and the Distance Contracts Regulation, regarding the sale and delivery of the product/service ordered electronically by the BUYER through the SELLER's website nsasoft.com.tr.
Product/Service and Payment Information
Product/Service Description, Duration and Price
The name, scope, duration and total price (including VAT) of the purchased software, license or subscription package are clearly shown to the BUYER on the relevant product page and at checkout, and are also sent to the BUYER in the order confirmation email.
Payment Method
Payments are collected via credit/debit card or other secure payment providers listed on the site (e.g. Lemon Squeezy). The payment method used is communicated to the BUYER at the time of order.
General Provisions
Access and Delivery
The product/service covered by this Agreement is digital software/a license; upon payment confirmation it is digitally provisioned/delivered to the email address or user account specified by the BUYER.
Usage Rights
The BUYER acknowledges and agrees that all intellectual property rights in the purchased software and digital services belong exclusively to the SELLER, and that the BUYER is granted only a right of use.
Liability
The SELLER is responsible for providing the service covered by this Agreement free of defects, complete, and in accordance with the specifications stated on the platform.
Right of Withdrawal and Exceptions
Where legally applicable, the BUYER has the right to withdraw from this Agreement within 14 (fourteen) days of delivery of the service, without giving any reason.
Cases Where the Right of Withdrawal Cannot Be Used
Pursuant to Article 15 of the Distance Contracts Regulation, the right of withdrawal cannot be exercised for services performed immediately in electronic form or for intangible goods delivered to the consumer immediately (software, digital license keys, instantly activated SaaS access, etc.).
Customized Services
There is no right of withdrawal for software and services that are customized, or on which special development/integration work is carried out, at the BUYER's specific request.
Privacy and Protection of Personal Data
The SELLER processes and protects personal data provided by the BUYER in accordance with Turkish Law No. 6698 on the Protection of Personal Data (KVKK). Further details are available in the KVKK Notice on the site.
Dispute Resolution
Disputes arising from this Agreement are subject to the jurisdiction of the Consumer Arbitration Committees and Consumer Courts of the BUYER's or SELLER's place of residence, within the monetary limits announced annually by the Ministry of Trade. Where the parties are merchants, the Courts and Enforcement Offices of Kocaeli (Gebze), Türkiye have jurisdiction.
Effect
By confirming the order and completing payment through the site/platform, the BUYER is deemed to have read, understood and accepted all terms of this Agreement.
